Gate Access Questions:

Question 1.  I live in Gateway Greens. I have been told by the guards at the guard gates that legally they can not restrict or deny a visitor entry to our community, regardless of whether they are a resident or an invited guest. Some guards have had confrontations when trying to deny repetitive random, non-resident drive in men in cars that insist on entry. When the guard said they could not enter, and pressed the point,[ as the person was  not a resident or invited/documented guest,] a Sherriff deputy became involved. Purportedly, the deputy said since  Gateway does NOT have a sign  that says "Residents Only" Gateway must allow all to enter.  I would like to know , definitively , what are the rules regarding entry into our community. Is anyone driving up  allowed in? What are the legal rules for this.   See answer

Question 2.  Have the security detail at the main gate been instructed to give visitors who come into GWG applications to obtain entry bar codes? I know of an instance where an application was given to one visitor and told to have it filled out and bring a check for $20 made out by the homeowner, and then bar codes would be applied to their autos. I was told at a GWG Community meeting that some homes had as many as 50 of these bar codes issued and that the practice was to end. What is the current Boards view on this?  See Answer

Question 3.   I'm sure I'm not the only person with this problem, since many of us drive SUV's and higher profile vehicles. I cannot get the card reader at the main gate or Walden Lakes to open the gate. The security officers have told me this is a very common problem. I know the issue is not with my vehicle, because there was a time when the reader would open the gate, Not anymore however. Are there any plans to address this matter. I'm sure it is frustrating to other owners behind me when I pull up to the gate and have to wait for the security officer to open it. I'm sure this is not the way it's supposed to work. Question 4.  The security systems within GGCA do not seem to work very well. What is the Board doing to fix these problems?  See Answer

Question 5.  Today again, with the rain the Westlinks' gate would not open for me and five other cars in line. The same thing has now happened to me numerous times when it is raining or has just stopped raining. I have been here for 7 years and just in last few months has that gate given me and many other residences any problems. Obviously, because of the "Bar Code Incident Report" there appears to be many concerns. Time for new equipment. Please respond as to what Gateway Greens Assoc is going to about this problem. Question 6.  The sign at the main gate to the HOA states that delivery or construction trucks are not allowed to use the main gate.  They are required to drive to the back gate, when the back gate is open.  I have seen these type trucks using the main gate during periods when the back gate is open for business:   USPS, FEDEX, FEDEX GROUND, HDL, & UPS.  Beer and soft drink, etc, trucks for the golf course bar, Whole sale food trucks for the golf course restaurant,  Large trailer (18 wheelers) bring in new golf carts for the golf course.  All of which can be defined as "delivery vehicles".

Yet when I need the services of a repair man in a small panel or pick up truck for electrical, plumbing, home appliance repair, etc, or to even come to my home to do any estimate for future work, they are directed to the back gate as second class individuals.  The days of a large number of homes under construction within the GG HOA are for the most part gone.  There are a few lots but not a "high" number requiring construction vehicles.

I believe the policy needs to be reviewed so all or any truck can come in the front gate. If that is not the case then "all" trucks must be directed to the second class back gate. See Answer

Question 7.  What is the policy regarding door-to-door canvassing inside of the Gateway Community?  I ask this in the context of it being three weeks before what is likely the most significant presidential election of my lifetime. I read the posted Q&As and have skimmed through the "Protective Covenant" document but did not find any specific mention.  See Response

Question 8: May 2009, Surely there are a lot of important items on your agenda, however, the following just irks me to no end. Frequently I have various young men park at the end of the cul-de-sal walk down the west side of my home and proceed to fish in the lake from my back yard. If they took the time to ask for permission I might be inclined to say yes. They just seem to think they have a right to use my property. Can I place a No-Trespassing/No Fishing sign on my property at the corner of my home. Even if I could I suppose enforcement would still be an issue. What do you think?  Still working on a response from law enforcement.
